Quaker®-Tropicana®-Gatorade® Choose Your Dream™ Contest (the “Contest”)


This Contest is intended for viewing and participation in the following regions only: (Region 1: Ontario, Region 2: Quebec, Region 3: West (Manitoba, Saskatchewan, Alberta, British Columbia) and Region 4: Atlantic (Nova Scotia, New Brunswick, Prince Edward Island, Newfoundland)) (each, a “Region”) and shall be construed and evaluated according to the laws of Canada. Please do not proceed unless you are a legal resident of one of the Regions noted above at the time of entry. Must be the age of majority or older in your province of residence to enter.
  1. The sponsor of this Contest is PepsiCo Canada ULC (“PepsiCo”) (the “Contest Sponsor”).


  2. CONTEST PERIOD: Starts approximately July 9, 2010 at 12:00:01 a.m. ET and ends July 29, 2010 at 11:59:59 p.m. ET (the “Contest Period”), after which time no further entries will be accepted.


  3. HOW TO ENTER: To enter, visit the Contest page at www.ChooseYourDream.ca during the Contest Period, and complete the online Contest entry form in full, by: (i) providing your first name, last name, complete address, age, email address and day-time and evening telephone numbers, (ii) selecting your Region of residence, (iii) selecting a store location of a Participating Store (defined below) (iv) correctly answering the mathematical skill-testing question and (v) entering one (1) valid UPC number found under the UPC symbol of any Quaker product or Tropicana or Gatorade beverage. To submit your entry, you will be required to confirm that you have read and agree to be bound by the Contest rules. There is a limit of one (1) Contest entry per individual and per email address per day during the Contest Period. Every time you submit an entry, you must select your Region of residence as well as a Participating Store location from the list provided. A different store location can be selected each time. Participating Stores are: Loblaws, Provigo, Fortinos, Zehrs, Your Independent Grocer, valu-mart, Extra Foods, Real Canadian Superstore, Atlantic SaveEasy, Dominion or Atlantic Superstore Only one (1) email address may be used by any person to participate in the Contest. Duplication may result in disqualification. All entries must be received by July 29, 2010 at 11:59:59 p.m. ET. In the event of a dispute regarding the identity of an e-mail entrant, the entry will be deemed to have been made by the authorized account holder of the e-mail address submitted at the time of entry. Authorized account holder is defined as the natural person who is assigned to an email address by an Internet access or, online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted email address.


  4. NO PURCHASE NECESSARY. If you wish to enter without purchase, please follow the entry instructions above, and when prompted, enter the following UPC number: 7887949943. Although online access and an email account are required in order to participate in the Contest, no purchase is required: many public libraries, Internet cafés, retail businesses and others offer access to the Internet and a number of Internet service providers and other companies offer free email accounts.


  5. PRIZES:
    Secondary Prizes: There are a total of 628 secondary prizes available to be won during the Contest Period - one (1) secondary prize to be awarded in respect of each designated location of a Participating Store. Each secondary prize consists of one (1) LCL gift card. approximate retail value of $50.

    Limit one (1) Secondary prize per household. Secondary prizes must be accepted as awarded, have no cash surrender value and no substitution or transfer of the secondary prizes are allowed, except for the Contest Sponsor’s right of prize substitution as per Rule 22 below.

    Grand Prize: There are a total of four (4) grand prizes available to be won during the Contest Period - one (1) grand prize to be awarded per Region. Once confirmed as a winner, each selected grand prize entrant will be able to choose one (1) of the following three (3) grand prize packages:

    C. One (1) gift card redeemable for $25,000 worth of gasoline. Vendor to be chosen at the discretion of the Contest Sponsor.

    Total Approximate Retail Value (“ARV”) of Dream Cars Package: $114,600, including applicable taxes, freight and PDI. Prize Winners are each responsible for all expenses which are not included in the prize description above, including but not limited to: any and all upgrades not outlined above, licensing, insurance, registration, gas consumption, maintenance, plate costs, and all other costs incurred in claiming, registering or using the vehicles. Winners will be required to take possession of the vehicles from the GM dealership closest to the winner’s place of residence (the “Dealership”). After being declared a winner, allow 16-20 weeks for the delivery of the prize vehicles to the Dealership. Once Winner(s) has been notified that the prize vehicles are at the Dealership, Winner(s) must take possession of the vehicles within four (4) weeks or prize may be forfeited. Winner (and/or winner’s designate) will be required to show proof of valid license and insurance before being allowed to drive the prize vehicles off the lot of the Dealership. The vehicles must be accepted as awarded; no cash trade-in or other vehicle substitution in lieu of the vehicle(s) permitted by Winner(s). The Contest Sponsor reserves the right, at its sole and absolute discretion, to substitute a prize vehicle with a vehicle of equivalent or greater monetary value or of a different model year for any reason including, but not limited to: delivery or production delays caused by labour disruptions, part shortages, or other unforeseen events, end of model year availability, and for any other reasons.

    **OnStar services require vehicle electrical system (including battery), wireless service, and GPS satellite signals to be available and operating for features to function properly. Not all OnStar features are available on all vehicles. OnStar Personal Calling (OPC) requires an OPC-enabled vehicle, existing OnStar service contract, and prepaid calling minutes, and is not available in Alaska and some other markets. Calls may be made to the U.S. and Canada only.
    OnStar voice recognition system may not work with some voices. OnStar acts as a link to existing emergency service providers. Subscription Service Agreement required. The U.S. Federal Communications Commission (FCC) ruled that Canadian and U.S. wireless carriers will no longer be required to support the analog wireless network after February 16, 2008.     Choice No. 2

    Dream Cottage Package consisting of:

    Dream Cottage Package (total approximate retail value CDN$200,000, including applicable taxes) from Les Industries Bonneville (“Bonneville”):

    Cottage package does not include property, foundation or anything not specifically included in the prize description below. Prior to accepting this prize, Winner may be required to show Contest Sponsor and/or Bonneville proof that he/she has clear title to the land on which he/she wishes the cottage to be built and any required permits, certificates or other documentation, as applicable.. Any costs associated with the purchase and/or preparation of a suitable lot including, but not limited to, lot leveling, filling of lot, transportation of any excess soil, removal of snow, filling and landscaping, will be the sole responsibility of Winner. Contest Sponsor and Bonneville will not be responsible should the construction of the cottage interfere with the peaceful enjoyment of neighbouring properties, easements over the property, or any other third party rights. Winner may be required to sign a document to this effect. Cottage package includes the following:

    Bonneville will deliver and assemble the Cottage to an approved lot designated by the grand prize Winner. Delivery and assembly of the Cottage must occur on a mutually agreed upon date between October, 1, 2012 and April 30, 2013, with the winner providing Bonneville with four (4) month’s notice before delivery, on a lot that is approved by Bonneville and which allows the vehicles transporting the modules easy access to the lot by public and homologated roads. The cottage will be completed within six (6) months from the date construction commenced. The soil on the chosen lot must be of normal quality. Neither Bonneville nor the Contest Sponsor will be held responsible for any damage to the Cottage resulting from soil that is not adapted to receiving pre-fabricated houses. Transportation is included within the following ranges: Ontario Region: within 100km of Ottawa, Quebec Region: within 200km of Beloeil; West Region: within 100km of Calgary, Alberta; Atlantic Region: within 100km of Moncton, New Brunswick. Additional transportation costs outside of each area are the responsibility of the grand prize winner and will be quoted and arranged through Bonneville, if required.

    All expenses not explicitly stated above such as, but not limited to, any necessary crane and other equipment fees; cost of all necessary permits, certificates, plans, duties, rights of transfer or any special taxes, earthworks and site grading; landscaping, leveling and filling; removal of trees and stumps or any existing building and extra soil; water and sewage connections to the foundation; basement finishing (no gyproc, walls or electricity and perimeter is not insulated); well, pump(s), septic systems and leaching beds; water purification system; survey certificate; implementation plan and construction permits; payment of any outstanding lot levies; notary fees and construction charges; land costs and filling of that land; blasting if necessary; backfill of land and landscaping; foundation, windows and doors for foundation; outside stone and bricks; furniture and decorations; fireplace and chimney; balconies, exterior ramps; cable tv, hydro and telephone hook-up fees; flower boxes, thermopump or air exchanger; cement parging, legal fees; property and other taxes; any upgrades or changes from Bonneville’s standard plans then in effect; and any other extras over and above Bonneville’s then standard specifications) are not included, and it will be the Winner‘s responsibility to incur and arrange for same, should they choose this Dream Cottage Package. Winner is responsible for obtaining all necessary permits and complying with all applicable legal and governmental requirements. Winner is responsible for ensuring that the nature of the soil must be normal and that Industries Bonneville is not responsible for any damage to the house on foundations due to inadequacy of soil.

    Choice No. 3

    Dream Vacations Package consisting of:

    Dream Vacations Package (total approximate retail value CDN$107,700.00), consisting of:

    A. $100,000.00 in travel gift certificates from Air Canada Vacations (which may be used by the Winner, subject to the terms and conditions set out herein, towards an Air Canada Vacations product to include airfare, accommodation and related services and fees (such as seat selection, departure taxes, in destination transfers from airport to hotel,and travel insurance incidental to, or forming part of, a travel package) of the Winner’s choosing, at any time, without expiration (the “Travel Certificate”); and

    B. A vacation for two (2) adults to a Sandals Resort in St Lucia (Sandals Regency St. Lucia, Sandals Halcyon Beach, or Sandals Grande St. Lucian) for seven (7) nights including round-trip airfare aboard Air Canada in Executive Class to St. Lucia from a major Canadian gateway served by Air Canada located closest to the grand prize winner’s place of residence, seven (7) nights accommodation (1 room based on double occupancy or comparable accommodations), transportation between destination airport and hotel, all meals daily, drinks and snacks (some conditions may apply), and a complimentary spa treatment (to a maximum value of $250 per couple). Should a Grand Prize Winner choose this Dream Vacations Package, he/she as well as his/her travelling companion are solely responsible for all costs not expressly described herein including, without limitation, applicable departure taxes, fuel/currency surcharges, in-flight meals/beverages and entertainment, seat selection fees meals and beverages not otherwise described above, room service, gratuities, merchandise, telephone calls, optional tours/excursions, motorized water sports, telephone calls, in-room movies, mini-bar, excess baggage costs, duties, insurance together with any required travel documentation, and all personal expenses of any kind or nature, together with any applicable overnight layover. Grand prize Winner and his/her travelling companion are also solely responsible for all costs incurred to and from the departure airport as the grand prize originates and terminates there. It is the sole responsibility of the grand prize Winner and his/her travelling companion to obtain all necessary travel documentation including, photos, passports and visas if applicable and to comply with any customs and immigration requirements. Contest Sponsor shall not be responsible if Winner or his/her traveling companion are denied entry into the destination country, or reentry into Canada. In such an instance, all resulting expenses shall be the sole responsibility of the Winner or his/her traveling companion and the prize may be forfeited in whole or in part. Grand prize Winner and his/her travelling companion must be able to travel at the times and dates as determined by the Contest Sponsor in its sole discretion failing which the Grand prize will be forfeited. Prize is based on space availability at the resort and confirmation of travel dates will only be provided 30 days prior to departure. The stay is subject for travel within one year from the date of issue of the prize certificate with black-out travel dates applicable between December 15, 2010 and March 31, 2011 and April 20, 2011 and April 25, 2011. It is recommended that Grand prize Winner and his/her travelling companion obtain sufficient personal insurance prior to departure. Travelling companion/guest for Sandals resort prize must be of legal age of majority or older in their respective province or territory of residence prior to commencement of travel.

    Approximate retail value of the Sandals Resort vacation is CDN $7,700, inclusive of applicable taxes (brochure value based on Toronto, ON departure). Value of trip may vary depending on city of departure. Sandals Resorts reserves the right to relocate any processed prize winners from their hotel of choice to an alternate resort with the chain or to alternate dates, based on availability of space.

    Subject to the terms and conditions set out herein, the Travel Certificate may be used by the Winner for one or more travel experiences, but all arrangements for travel, accommodation and/or other eligible services (“Services”) must be made by the Winner through, or with the express written approval of, Air Canada Vacations. All requests for redemption of Travel Certificate must be made by the Winner and organized directly with Air Canada Vacations. Any expenses of the Winner and or his/her travelling companion/guest in excess of the $100,000.00 Travel Certificate are the sole responsibility of the Winner. The Contest Sponsor accepts no responsibility whatsoever for arranging or obtaining any Services, the sole responsibility for which rests with the Winner, subject to the terms and conditions set out herein.

    The Contest Sponsor accepts no responsibility for the selection, availability, suitability, timeliness, adequacy or results of any Services and makes no representation or warranty of any kind or nature whatsoever, express or implied, with respect to any such Service, including without limitation any warranty as to merchantability or fitness for purpose. Once travel, accommodation or other Service details have been confirmed with Air Canada Vacations, all applicable carrier, hotel/accommodation and/or other Service provider terms and conditions apply, including without limitation charges or penalties for changes or cancellation, which charges and/or penalties, if any, shall be the sole responsibility of the Winner. Winner and his/her travelling companion/guest are responsible for obtaining all necessary passports, visas and/or other required travel documentation and must travel together, unless otherwise agreed by the Contest Sponsor in its sole and absolute discretion. Travelling companion/guest who are minors must be accompanied at all times by a parent or legal guardian.

    > The prize is not transferable, must be accepted as awarded once choice is made between the 3 packages and no substitutions or transfer of the grand prize is allowed; and the Contest Sponsor reserves the right of prize substitution, as per Rule 22 below. The prize may not be used towards any frequent flyer/mileage accumulation program,


  6. CONTEST DRAWS:
    Secondary Prize Draws:

    A random draw will be held by an independent judging organization at 5225 Satellite Drive, Mississauga, Ontario, L4W 5P9 on Friday, August 13, 2010 from all eligible entries received during the Contest Period. One (1) eligible entrant will be selected for each location of each Participating Store, as being the potential Winner of a secondary prize. The odds of winning a secondary prize are dependant on the number of eligible entries received in respect of that designated Participating Store location. Secondary prize selected entries will be re-entered for the grand prize draw.

    Grand Prize Draw:

    The grand prize draws will also take place at 5225 Satellite Drive, Mississauga, Ontario L4W 5P9 on Friday, August 13, 2010 immediately following completion of the secondary prize draw. One (1) entry will be randomly selected from among all entries received per Region. The odds of your entry being drawn depend on the total number of eligible entries received during the Contest Period per Region.

    No responsibility is assumed by the Contest Sponsor for any inability for a potential entrant to successfully enter any draw for any reason. The Contest Group (as defined herein) is not responsible for late, lost, damaged, misdirected, mutilated, garbled or incomplete entries. Proof of transmission (screenshots or captures of game play etc.) does not constitute proof of delivery.


  7. HOW TO WIN AND CLAIM A PRIZE.

    Secondary Prize:

    Each potential secondary prize Winner will be notified by phone, mail or email and instructed how to claim his/her prize. To be declared a secondary prize Winner, each potential Winner drawn must have correctly answered the required mathematical skill-testing question administered online at the time of entry, must sign the Contest Sponsor’s form of Declaration of Compliance and Release (see Rule No. 8 below), and otherwise comply with the official Contest rules.

    Grand Prize:

    Each potential grand prize Winner will be notified by phone or mail and instructed how to claim his/her prize. To be declared a grand prize Winner, each potential Winner drawn must have correctly answered the required mathematical skill-testing question to be administered by phone at a mutually convenient time, must sign the Contest Sponsor’s form of Declaration of Compliance and Release (see Rule No. 8 below), and otherwise comply with the official Contest rules. If the eligible winner of a grand prize has already been awarded a secondary prize, then before being declared the winner of a grand prize, he/she must correctly answer without assistance of any kind, whether mechanical or otherwise, an additional mathematical skill-testing question to be administered at a mutually convenient time by telephone.

    Each potential Winner may be required to furnish proof of identification that may include a valid driver’s license or other form of government-issued picture identification as part of the verification process. If a potential Winner cannot be located or does not respond within 14 days of notification, the potential Winner will be disqualified and forfeits the prize and the Contest Sponsor may, at its sole and absolute discretion, select by random draw another eligible entrant whom the Contest Sponsor or its representatives will attempt to contact, and who will be subject to disqualification, in the same manner. The Contest Sponsor will not be responsible for failed attempts to notify any potential Winner.

    Awarding of a prize is subject to verification and compliance with the official Contest rules. Allow four (4) to six (6) weeks for verification of contest Winners. Grand prize Winner(s) will be contacted following verification with details on how to redeem their prize; exact time for fulfillment will vary depending on grand prize package chosen by each Winner. The Contest Sponsor will not be responsible for failed attempts to notify a selected entrant. Contest Sponsor makes no representations or warranties of any kind concerning the appearance, safety or performance of any prize. Winner bears all risk of loss or damages to prizes after receipt. Unclaimed prizes will not be awarded.



  8. ADDITIONAL CONDITIONS OF PARTICIPATION. By participating in this Contest, each entrant accepts and agrees to these official Contest rules and all decisions of the Contest judges (who may be employees, agents or independent contractors of Contest Sponsor), which shall be final and legally binding on the entrant in all matters relating to this Contest including, without limitation, eligibility and/or disqualification of entries. All entries become the property of the Contest Sponsor and will not be returned. In order to be confirmed a Winner and receive a prize, each potential Winner will be required to sign the Contest Sponsor’s form of Declaration of Compliance and Release which confirms compliance with these official contest rules and releases the Contest Sponsor and Loblaw Inc. and their respective affiliated companies, agencies, contest prize suppliers (including Air Canada Vacations, Sandals Resorts and Beaches Resorts, Bonneville, GM Canada and the Dealership) and their respective officers, directors, employees and agents and franchisees (collectively, the “Contest Group”) from all liability with respect to the entrant’s participation in this Contest and the awarding and use of the prize(s). Each potential Winner agrees to the use of his/her name, comments, photograph, and other likeness for publicity purposes, and grants to the Contest Group any and all rights to said use without further compensation. Entrants who have not complied with the official contest rules will be disqualified.


  9. Entrants and/or Winners assume liability for injuries caused, or claimed to be caused by participating in the Contest, by the acceptance, possession, or use or misuse of any prize awarded, including but not limited to claims/damages for personal injury (including death), or property damage.


  10. Any attempt by an entrant or other individual, to deliberately damage any website or undermine the legitimate operation of this Contest, including but not limited to any fraudulent claims, is a violation of criminal and civil laws. Should such an attempt be made, the Contest Sponsor reserves the right to seek remedies and damages from any such individual, to the fullest extent permitted by law, including criminal prosecution. Participant engaging in any of the foregoing activities may be disqualified and will forfeit any prizes won.


  11. Entries generated by script, macro, robotic, programmed, or any other automated means are prohibited and will be disqualified.


  12. ELIGIBILITY. Contest is open to residents of each Region (defined above) over the age of majority in their respective province of residence, except employees, representatives and agents of the Contest Sponsor and Contest Group or their respective affiliates and if applicable, their respective advertising or promotion agencies, contest judges, contest prize suppliers (including Air Canada Vacations, Sandals Resorts and Beaches Resorts, Bonneville and GM Canada) any other companies engaged in the development, production, or distribution of materials for this Contest, and members of the immediate families of, or persons domiciled with, any of the above.


  13. LIMITATION OF LIABILITY. By entering this Contest, each Winner acknowledges and agrees that the Contest Group: (i) shall have no liability of any kind whatsoever with respect to this Contest and/or the awarding, use, misuse or participation in any prize, (ii) make no warranty, guaranty or representation of any kind concerning the prize, (iii) disclaim any implied warranty, and (iv) are not liable for injury (including death), loss or damage of any kind resulting from the entrant’s acceptance, use, misuse or participation in any prize or otherwise from such entrant’s participation in this Contest.


  14. Subject only to the approval of the Régie des alcools, des course et des jeux in Quebec, the Contest Sponsor and its affiliates may, at their sole discretion and without liability, terminate the Contest in whole or in part, without notice, or to modify or suspend the Contest at any time if fraud, technical failures including any network server or hardware failure, viruses, bugs, errors in programming, or communications or any other errors or other causes beyond the control of the Contest Sponsor corrupt the administration, integrity or security of the Contest or if any other factor interferes with the conduct of this Contest as contemplated by these official contest rules.


  15. The Contest Group is not responsible for typographical or other errors in the offer or administration of this Contest, including but not limited to, errors in advertising, the official rules, the announcement of Winners, distribution of the prizes or technical malfunctions of telephone network lines, computer online systems, servers or providers, computer equipment or software, viruses, bugs, failure of personal computers and/or software and hardware configurations, or failure of any email to be received by the Contest Sponsor or a participant for any reason including but not limited to traffic congestion on the Internet or at any website or combination thereof. The Contest Group is not responsible for damage to a user’s system occasioned by participation in this Contest or downloading any information necessary to participate in this Contest.


  16. The Contest Group does not warrant that access to or use of the Contest will be uninterrupted or error-free.


  17. Under no circumstances, including negligence, shall the Contest Group be liable for any direct, indirect, incidental, special or consequential damages that result from the use of or inability to use the service, or out of any breach of any warranty. This exclusion or limitation of liability will not apply to the extent that any applicable statue prohibits such exclusion or limitation of liability.


  18. This Contest is subject to all applicable federal, provincial and municipal laws.


  19. Outside of the province of Quebec, all issues and questions concerning the construction, validity, interpretation and enforceability of these official Contest rules, or the rights and obligations of entrant and the Contest Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the substantive laws of the Province of Ontario without regard to Ontario conflicts of law principles. All entrants consent to the jurisdiction and venue of the Province of Ontario.


  20. QUEBEC RESIDENTS ONLY: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des course et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.


  21. PERSONAL INFORMATION. Unless entrants otherwise indicate, the personal information gathered about entrants in the course of this Contest will be used solely by the Contest Sponsor for the administration of the Contest and will be used by the Contest Group in connection with any publicity relating to the Contest.


  22. The Contest Sponsor reserves the right, at its sole and absolute discretion, to substitute any of the prizes (or any component thereof) for one of approximately equal or greater retail value, at any time and for any reason, including without limitation by way of cash award.
